In case Murray was sleeping during civics class this action would be within the Vice President or other assigned 'superiors' authority. It is also not an uncommon practice as the left would have us believe, as many presidents in the past on both sides of the isle have declassed information and made it public to boaster their cause. President Roosevelt was notorious for this during WWII (and even a little bit before).
Nontheless the Kos Kids and the rest of the lunes on the left will no doubt have a ball with it. But very simply Libby's lawyers are trying the "North Defense", although I will say that my sources are a little skeptical of this report from the get go. More on that later.
